Terms of Service

These Terms of Service ("Terms") govern access to and use of the Accuracy website, email verification platform, APIs, bulk verification services, dashboards, verification results, and related products and services (collectively, the "Services").

Accuracy operates online from India ("Accuracy", "we", "us", or "our").

By creating an account, purchasing credits, accessing an API, uploading data, or otherwise using the Services, you agree to these Terms. If you use the Services for an organization, you represent that you have authority to bind that organization.

Our Privacy Policy and Acceptable Use Policy are incorporated into these Terms by reference.

You may use the Services only if you are legally capable of entering a binding agreement, are authorized to act for your organization where applicable, and your use is permitted by applicable law.

The Services are intended primarily for businesses and professionals and are not directed to children.

Accuracy provides email verification services that may include:

We may add, modify, replace, or discontinue features from time to time.

• individual email verification;
• bulk CSV, JSON, XLS, and XLSX email verification;
• email verification APIs;
• syntax validation;
• domain, DNS, and MX checks;
• SMTP-based verification;
• catch-all detection;
• disposable-email detection;
• role-account detection;
• risk classification;
• verification history and exports;
• API keys and usage statistics; and
• verification credits.

Accuracy may classify addresses as Valid, Invalid, Risky, Unknown, or using other documented statuses and reason codes.

Verification is based on technical signals available at the time of the request. Results are informational assessments and are not guarantees of delivery.

A result does not guarantee that an address belongs to a particular person, is actively monitored, will remain valid, has consented to receive messages, or may lawfully be contacted.

Mail-server policies, DNS changes, greylisting, anti-abuse controls, temporary failures, rate limits, and network conditions can affect results.

You agree to provide accurate account information, protect access to your account and email, safeguard API keys, restrict access to authorized users, and promptly notify us of suspected unauthorized use.

Accuracy may use passwordless authentication, including one-time passwords ("OTP") delivered to your registered email address.

You are responsible for activity performed through your account and credentials.

A new eligible account receives 100 free verification credits without a payment-card requirement.

Free and purchased credits do not expire. Free credits:

Creating multiple accounts to circumvent promotional limits is prohibited.

• have no cash value;
• cannot be transferred, resold, or redeemed for cash;
• remain available until used;
• may be limited per person, company, domain, payment method, or other reasonable identifier; and
• may be modified or discontinued prospectively.

Accuracy may use a credit-based billing model. Verification credits represent units used for eligible verification operations.

One credit is charged for each valid, invalid, catch-all, or risky verification result. Unknown, syntax-invalid, duplicate, execution-failed, and cancelled results use zero credits.

Credits have no cash or stored-value equivalent and may not be transferred between unrelated accounts without permission.

The rules shown on the Pricing or checkout page at purchase form part of these Terms.

• One credit: valid, invalid, risky, and catch-all results.
• Zero credits: unknown, syntax-invalid, duplicate, execution-failed, and cancelled results.

Purchased credits do not expire and remain in your account until you use them.

Free credits also remain available until used.

Current pricing is displayed at /pricing or in an applicable written order.

The published plans are Free, Starter, Growth, Business, Scale, and Enterprise. Standard plans are one-time credit purchases with no recurring monthly subscription.

The Pricing page shows the current credit quantity, price, per-email rate, currency, and included features for each plan.

We may change prices prospectively. Changes do not retroactively alter completed purchases unless required by law.

When purchasing paid Services, you agree to provide valid billing information and pay applicable charges and taxes.

Available payment methods are shown securely at checkout and may vary by region.

Public prices are currently stated in USD unless the Pricing page, checkout, or a written order expressly states another currency.

Prices may exclude applicable GST, VAT, sales tax, withholding tax, duties, or similar charges unless otherwise stated.

You are responsible for applicable taxes except taxes based on Accuracy's net income. Accuracy may calculate and collect taxes where required.

You may request a refund for unused purchased credits within 30 days of purchase. Applicable taxes are deducted from the refund.

Promotional credits and credits that have already been used are not refundable. Any rights required by applicable law continue to apply.

"Customer Data" includes email addresses, uploaded files, API requests, and related information you submit to the Services.

As between you and Accuracy, you retain your rights in Customer Data.

You authorize Accuracy to process Customer Data as reasonably necessary to provide verification, generate results, maintain and secure the Services, prevent fraud and abuse, provide support, comply with law, and fulfill contractual obligations.

Personal information is handled as described in our Privacy Policy and, where applicable, Data Processing Agreement.

You represent that you have the rights, permissions, notices, consents, or lawful bases necessary to submit and process Customer Data through Accuracy.

You are responsible for the legality and source of your lists, required privacy notices and consents, subsequent use of results, and compliance with privacy, marketing, anti-spam, consumer-protection, and data-protection laws.

A Valid verification result does not grant permission or consent to contact an address.

You must comply with our Acceptable Use Policy.

You must not use Accuracy for unlawful spam, stolen or unlawfully obtained datasets, phishing, fraud, scams, malicious account enumeration, unauthorized probing, malware, circumvention of technical restrictions, infringement of third-party rights, or other unlawful or abusive activity.

Bulk verification may allow submission of supported files containing multiple email addresses.

You are responsible for ensuring uploaded data is lawful and authorized, avoiding unnecessary sensitive information, reviewing results before acting on them, and securely handling exported data.

File-size, quantity, concurrency, and processing limits may vary by account or plan.

You agree to keep API keys confidential, use APIs only from authorized systems, follow technical requirements and rate limits, implement reasonable error/retry handling, rotate compromised keys, and avoid exposing private keys in client-side applications.

We may throttle or temporarily reject requests where necessary for reliability, security, abuse prevention, or protection of third-party infrastructure.

Services may have rate, concurrency, domain-level, file-size, account, and other safeguards.

Attempting to bypass restrictions through multiple accounts, credentials, IP addresses, or similar methods is prohibited.

We aim to provide reliable Services but do not guarantee uninterrupted or error-free availability.

Services may be affected by maintenance, infrastructure or network failures, third-party failures, DNS or email-provider restrictions, security incidents, force majeure events, or other circumstances outside our reasonable control.

Unless expressly agreed in writing, no specific SLA applies.

Some attempts may return Unknown because a definitive response cannot be obtained, including because of SMTP timeouts, greylisting, temporary server errors, connection failures, rate limiting, anti-abuse systems, or unavailable mail servers.

Accuracy may retry certain operations. Retries do not guarantee a definitive result.

Credit treatment follows the applicable Pricing and credit rules.

Customer Data and results are retained according to our Privacy Policy, account settings, applicable order, or DPA.

By default, original bulk-upload source files and row-level verification items are scheduled for deletion after 7 days, generated result exports after 30 days, and abandoned uploads after 24 hours. Bulk-job metadata is assigned a 365-day expiry.

These are deployment settings. Deletion occurs asynchronously when scheduled cleanup handles the expired data.

You are responsible for downloading results you wish to retain before applicable deletion periods expire.

Accuracy and its licensors retain all rights in the Services, software, APIs, website, designs, trademarks, documentation, verification technology, algorithms, and user interfaces.

Subject to these Terms, Accuracy grants you a limited, non-exclusive, non-transferable, revocable right to use the Services for authorized business purposes.

If you provide suggestions or feedback about Accuracy, you permit us to use that feedback to improve or develop the Services without compensation. This does not transfer ownership of Customer Data.

The Services may rely on or integrate with third-party services. Accuracy is not responsible for third-party products or services outside our control. Separate third-party terms may apply.

We may restrict or suspend access where reasonably necessary to address security threats, suspected fraud, abuse, unpaid charges, legal requirements, infrastructure risks, third-party complaints, or violations of these Terms or the Acceptable Use Policy.

Where reasonable and legally permitted, we may provide notice and an opportunity to resolve the issue.

You may stop using the Services and request account closure.

We may terminate or suspend accounts for material violations, unacceptable use, non-payment, security/legal risk, threats to service reliability, legal requirements, or discontinuation of the Services.

Treatment of unused credits following termination depends on the reason for termination, refund rules, and applicable law.

Provisions that by nature should survive termination remain effective, including payment obligations, intellectual property, confidentiality, disclaimers, liability limitations, indemnification, dispute resolution, and governing law.

Customer Data may be deleted according to our retention policies.

Each party will use reasonable measures to protect non-public information that is marked confidential or reasonably understood to be confidential and use it only for purposes related to the Services.

Confidentiality does not cover information lawfully public, previously known without restriction, independently developed, or lawfully received from another source.

Accuracy uses reasonable administrative, technical, and organizational safeguards designed to protect the Services and Customer Data. No online service can guarantee absolute security.

You remain responsible for securing your account, email account, API keys, devices, integrations, and exported data.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

ACCURACY DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OF RESULTS, UNINTERRUPTED AVAILABILITY, AND ERROR-FREE OPERATION.

WE DO NOT WARRANT THAT A VERIFICATION RESULT GUARANTEES DELIVERY OR THAT AN ADDRESS WILL REMAIN DELIVERABLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACCURACY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, REVENUE, BUSINESS OPPORTUNITIES, GOODWILL, OR DATA.

Accuracy's aggregate liability is limited only to the extent permitted by applicable law and any separately signed agreement.

Nothing excludes or limits liability that cannot legally be excluded or limited.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Accuracy and its affiliates, officers, employees, and contractors from claims, losses, liabilities, and reasonable costs arising from your Customer Data, unlawful use of email addresses, violation of these Terms or law, infringement of third-party rights, or email marketing/outreach activities.

Accuracy operates from India, and these Terms remain subject to applicable law.

A separately signed agreement may specify governing law or a dispute forum for that agreement.

Before formal proceedings, the parties agree to make reasonable efforts to resolve disputes informally.

Legal notices and dispute-related correspondence should be sent to legal@accuracy.email.

Any dispute process required by applicable law or a separately signed agreement continues to apply.

Accuracy is not liable for delay or failure caused by events beyond reasonable control, including natural disasters, war, civil unrest, labor disputes, telecommunications failures, power outages, government actions, or widespread third-party infrastructure outages.

We may add, modify, remove, or replace functionality and technical limits. Where changes materially affect paid Services, we will make reasonable efforts to provide notice where appropriate.

We may update these Terms. We will update the Last Updated date and may provide additional notice for material changes through email, the dashboard, website, or another reasonable method.

Continued use after updated Terms become effective constitutes acceptance where permitted by law.

These Terms, together with our Privacy Policy, Acceptable Use Policy, applicable DPA, order forms, and other incorporated terms constitute the agreement regarding the Services.

A separately signed agreement controls to the extent it expressly conflicts with these Terms.

If any provision is unenforceable, the remaining provisions remain effective, and the affected provision will be modified to the minimum extent necessary where permitted.

Failure to enforce a provision does not waive the right to enforce it later.

You may not assign these Terms without our prior written consent.

Accuracy may assign them in connection with a merger, acquisition, restructuring, financing, or sale of all or substantially all of its business or assets.
